These Terms of Service (“Terms”) govern your use of Giftodactyl – Family Wishlists (“Giftodactyl,” the “app,” or the “service”).

Giftodactyl is operated by WildPasta Co, LLC (“WPC,” “we,” “us,” or “our”).

By creating or using an adult Giftodactyl account, you agree to these Terms. If you establish or supervise a supervised account, you also agree to these Terms in connection with your role as supervisor and confirm that you have authority to provide any consent required for the supervised user’s use of Giftodactyl.

Supervised users must follow these Terms while using the service. Where applicable law requires additional consent or different treatment based on age, those requirements apply.

If you do not agree to these Terms, do not use Giftodactyl.

1. What Giftodactyl Is

Giftodactyl is a private, relationship-based wishlist and gift-coordination service.

Users can create profiles and wishlists, connect with other profiles, coordinate gift claims, comment on items, organize Gift Exchanges, and use related gifting features.

Giftodactyl is not a retailer, marketplace, payment processor, escrow service, delivery service, or purchasing agent. Purchases made through third-party merchants are separate transactions between the user and the merchant.

2. Accounts, Ages, and Eligibility

Giftodactyl’s standard account structure is:

• Under 13: no independent Giftodactyl account; an adult may create a managed profile representing the child.

• Ages 13–17: a supervised account associated with a supervising adult.

• 18 and older: an ordinary adult account.

Different age, consent, or supervision requirements may apply in some countries or regions. Where applicable law requires different treatment, those requirements control, and Giftodactyl may change account eligibility, supervision requirements, or feature availability accordingly.

You must provide accurate information when Giftodactyl asks for information used to determine account eligibility or supervision. You may not misrepresent your age or other information to bypass eligibility or supervision requirements.

3. Your Account

You are responsible for keeping your account credentials secure and for activity performed through your account.

You may not:

• access another person’s account without authorization;

• impersonate another person;

• provide materially false account information;

• attempt to bypass account, age, supervision, safety, or security controls; or

• use another person’s credentials to obtain access you would not otherwise have.

Giftodactyl uses profiles to represent people or other gift recipients within the service. An account may control or interact with more than one profile depending on the features and permissions available to it.

4. Managed Profiles

A managed profile does not have its own independent login. It is operated through another Giftodactyl account and may represent a child, dependent, another person, pet, or other gift recipient.

If you create or manage a profile representing another person, you represent that you have the permission or authority required to provide and manage that person’s information.

The account controlling a managed profile is responsible for activity performed on behalf of that profile.

Managed profiles are different from supervised accounts. A supervised user has their own login and uses Giftodactyl themselves rather than having another user simply act as them.

5. Supervised Accounts

Users ages 13 through 17 use Giftodactyl through supervised accounts associated with a supervising adult.

The supervised user has their own login and uses Giftodactyl themselves. The supervisor manages safety and permission settings for the supervised account.

Depending on the settings chosen by the supervisor, this may include control over:

• connections and connection requests;

• access to connection links;

• whether the supervised user may create or receive comments;

• whether the supervised user may change certain profile or account settings; and

• other social or safety-related features.

The supervisor has broad access to information associated with the supervised profile through Giftodactyl’s supervision features. This can include information that may not otherwise be visible to the supervised user in their own view.

Supervision does not turn the supervised user into a managed profile or authorize the supervisor to impersonate the supervised user.

Gift Exchanges and other Giftodactyl features remain subject to the same supervision and permission rules. They are not a way to bypass supervised-account restrictions.

6. Connections

Giftodactyl is designed around permission-based connections rather than public profile discovery.

Profiles are not publicly searchable.

Connection links and invitations allow someone to begin a connection process. Possessing a connection link does not automatically make that person a trusted connection or give them access to the profile’s content.

For supervised users, connection requests may require approval by the supervisor or another person to whom the supervisor has granted that authority.

You are responsible for deciding whom you connect with and for using the visibility and permission controls provided by Giftodactyl.

7. Wishlists, Lists, and Items

Giftodactyl allows users to create and organize wishlist items.

Items may contain information such as:

• title and description;

• price;

• images;

• merchant or product URL;

• importance;

• location information you choose to provide;

• list membership; and

• visibility settings.

Giftodactyl provides controls for choosing who can see the information you add, subject to the account, connection, supervision, and permission rules of the service.

When you provide a merchant or product URL, Giftodactyl may retrieve product information such as the product title, price, merchant name, or product images to help populate the item.

We may correct, stop retrieving, restrict, or remove imported information where reasonably necessary for technical, legal, security, rights, or policy reasons.

8. Claims

Claims are a gift-coordination feature.

When a user claims an item, they are indicating that they intend to handle or purchase that gift.

A claim is not:

• a purchase;

• an order;

• a reservation with the merchant;

• a payment commitment;

• a contract between users; or

• a guarantee that the gift will actually be purchased or delivered.

The owner of an item does not see whether that item has been claimed.

Other profiles who are permitted to view the item may see whether it is claimed or unclaimed, but Giftodactyl does not show them who made the claim.

A supervisor may have broader visibility for a supervised profile as described in Section 5.

Claims exist to help gift-givers coordinate and reduce duplicate gifts.

9. Comments

Giftodactyl allows users to comment on wishlist items.

Comments may be configured to:

• include the owner of the item; or

• exclude the owner so other gift-givers can coordinate without spoiling a surprise.

When a comment excludes the item owner, profiles who otherwise have permission to view the item can see that comment, except for the item owner.

Giftodactyl does not create a separate private messaging system merely because users are discussing a gift. Normal item, visibility, connection, and supervision rules continue to apply.

10. Gift Exchanges

Giftodactyl may allow users to organize private Gift Exchanges, such as Secret Santa or recurring family gift swaps.

An organizer may create an exchange, invite connected profiles, associate it with a date or event, and provide information such as a theme, suggested budget, or response deadline.

Invited participants may accept or decline. Participants included when the exchange is finalized may then be assigned another participant as their gift recipient.

Giftodactyl provides tools for organizing and coordinating the exchange. Giftodactyl does not itself participate in the exchange of gifts, choose gifts for participants, process payments between participants, or guarantee that a participant will purchase or deliver a gift.

Assignments

Giftodactyl may consider preferences when generating assignments, such as avoiding a particular match or avoiding a previous pairing.

These preferences are not guaranteed. The matching process may disregard optional preferences when necessary to create a valid exchange, and Giftodactyl does not guarantee that an assignment can always be generated.

Regenerating or re-finalizing an exchange may change existing assignments.

Assignment privacy

Gift Exchange assignments are intentionally private.

A giver can see the recipient assigned to them and the recipient information and wishlist content they are otherwise permitted to access.

The recipient does not see who was assigned to them.

Participants do not receive access to everyone else’s assignments merely because they participate in the exchange. Organizer status alone does not mean the organizer can see every assignment.

Wishlists, claims, and comments

Gift Exchanges use Giftodactyl’s ordinary wishlists, items, claims, comments, visibility settings, and permissions.

They do not create a separate inventory of exchange-only gifts or a separate exchange chat.

A participant may claim an item from their assigned recipient’s permitted wishlist, but the ordinary claim rules continue to apply. Claimant identity is not exposed merely because the claim occurs as part of a Gift Exchange.

Suggested budgets

An exchange may include a suggested budget or other spending guidance.

Any such amount is informational only.

Giftodactyl does not:

• collect or hold exchange funds;

• enforce spending limits;

• split payments;

• require participants to spend equal amounts;

• reimburse participants; or

• resolve disputes about the cost, quality, or suitability of gifts.

Each participant remains responsible for deciding whether and what to purchase and for any transaction they separately enter into with a merchant.

11. Your Content

“User Content” includes information you intentionally submit to Giftodactyl, such as profile information, wishlist text, images, comments, list names, event information, Gift Exchange information, and similar material.

You retain whatever ownership rights you have in your User Content.

You give WildPasta Co, LLC a non-exclusive license to host, store, process, copy, display, and otherwise use your User Content as reasonably necessary to:

• provide Giftodactyl;

• display content to people authorized to see it;

• operate visibility, supervision, connection, and Gift Exchange features;

• maintain and secure the service;

• create operational backups;

• investigate reports or misuse;

• enforce these Terms; and

• comply with legal obligations.

This license does not give WPC ownership of your User Content.

The license lasts only as long as reasonably necessary for these purposes. When your content is deleted, the license ends for that content except to the extent copies temporarily remain in backups or retention is required for legitimate legal, security, or operational purposes.

You represent that the content you intentionally submit and your use of it through Giftodactyl do not violate applicable law or the rights of others.

That representation does not mean that you personally guarantee ownership of merchant product information or images that Giftodactyl itself retrieves from a product URL.

12. Content and Products

Giftodactyl is used by both adults and teens, and we don't make judgments about lawful adult interests or purchases. However, some content and transactions cannot be supported through Giftodactyl because of legal, safety, or app-store requirements.

Don't use Giftodactyl to post sexually explicit material, exploit or endanger others, or use Giftodactyl's links, shopping features, or other functionality to facilitate transactions that are illegal or prohibited by the platforms through which Giftodactyl is distributed.

Content that violates these rules may be removed or restricted, and repeated or serious violations may result in account restrictions.

Giftodactyl may also restrict, modify, or disable particular linking or shopping functionality where necessary to comply with applicable law, security requirements, merchant or affiliate-program requirements, or the rules of platforms through which Giftodactyl is distributed.

Giftodactyl does not attempt to inspect, classify, or pre-approve every item users add to their wishlists.

13. Other Prohibited Conduct

You may not use Giftodactyl to:

• violate applicable law;

• exploit, abuse, threaten, or endanger another person;

• harass another user;

• commit fraud or impersonate another person;

• distribute malware or malicious code;

• interfere with or disrupt the service;

• attempt unauthorized access to accounts, systems, or data;

• circumvent age, access, supervision, safety, or security controls;

• scrape or extract Giftodactyl data through unauthorized automated means;

• reverse engineer or attempt to obtain the service’s source code except where applicable law expressly permits it;

• violate another person’s intellectual-property, privacy, or other legal rights; or

• use Giftodactyl functionality to facilitate transactions the service cannot legally or contractually support.

14. Reporting, Blocking, and Moderation

Giftodactyl provides tools for reporting users or content and for blocking other profiles.

We may review reports and take action where appropriate.

Depending on the circumstances, we may:

• remove or restrict content;

• restrict visibility;

• disable links or shopping functionality;

• limit account features;

• suspend or terminate an account;

• preserve information where reasonably necessary for investigation, security, or legal purposes; or

• report unlawful conduct where required by law.

We do not promise that every report will result in removal, suspension, or another particular outcome.

Giftodactyl does not proactively inspect or pre-approve every item, image, comment, or other piece of User Content.

15. Third-Party Merchants and Shop Now

Giftodactyl may provide Shop Now buttons or other links to third-party merchant websites.

When you use one of these links, the merchant website opens through your device’s external or default browser.

Giftodactyl does not operate the merchant website or process the purchase.

Third-party merchants are responsible for their own:

• prices;

• inventory;

• product information;

• payment processing;

• shipping and fulfillment;

• returns and refunds;

• warranties;

• terms; and

• privacy practices.

Product information displayed in Giftodactyl may become outdated, incomplete, or inaccurate.

Any purchase is a separate transaction between you and the merchant. Giftodactyl does not guarantee merchant availability, product quality, fulfillment, or delivery.

16. Affiliate Links

Some Shop Now links may be routed through or converted into affiliate links when an eligible affiliate program is available.

If you follow an affiliate link and complete a qualifying transaction, the merchant or affiliate provider may pay WildPasta Co, LLC a commission.

You do not pay more because a link is an affiliate link.

Not every link or merchant will be eligible for monetization, and the availability of affiliate programs may change.

An affiliate relationship does not mean Giftodactyl endorses, controls, or guarantees the merchant or product.

17. Giftodactyl Intellectual Property

Giftodactyl itself, including its software, interfaces, branding, graphics, illustrations, icons, logos, text, and other materials created by or for WildPasta Co, LLC, is owned by WPC or licensed to us.

Subject to these Terms, we give you a limited, non-exclusive, non-transferable license to use Giftodactyl for its intended purposes.

You may not copy, distribute, resell, commercially exploit, or create unauthorized derivative versions of Giftodactyl itself except with our permission or where applicable law permits it.

This section does not transfer ownership of your User Content to us.

18. Availability and Changes

Giftodactyl will change over time.

We may add, update, modify, restrict, or remove features and may change how particular features operate.

We may also stop offering Giftodactyl or particular features in certain countries, regions, app stores, or circumstances.

We do not guarantee uninterrupted or error-free availability.

Features described in these Terms apply when those features are available to you.

19. Suspension and Termination

We may restrict, suspend, or terminate access to Giftodactyl where reasonably necessary because of:

• serious or repeated violations of these Terms;

• fraud or abuse;

• unlawful conduct;

• threats to users or the service;

• security concerns;

• requirements imposed by law or distribution platforms; or

• other conduct that materially interferes with Giftodactyl or the rights of others.

Where appropriate, we may take a more limited action instead, such as restricting a feature, link, item, or piece of content.

Suspending or terminating access does not necessarily result in immediate deletion of the account or its associated information. Account and data deletion are handled separately as described below and in our Privacy Policy.

20. Account Deletion

You may begin the account-deletion process through the option provided in Giftodactyl.

The in-app option opens Giftodactyl’s account-deletion information and provides a way to contact accounts@giftodactyl.com to submit the request.

When an account is deleted, profiles, items, lists, images, settings, and other information controlled by that account are deleted, subject to the exceptions described below.

Managed profiles controlled by the account are deleted with the account.

Content contributed to another user’s item may be deleted or de-identified depending on the type of content and how it is associated with that item.

Deleting a supervised account or a supervising adult’s account may require additional steps to resolve the supervision relationship.

Deletion may also affect claims, Gift Exchange participation, assignments, or other records involving multiple users.

Because Gift Exchange assignments can affect multiple participants, Giftodactyl may retain limited historical or audit information where reasonably necessary to maintain consistency, prevent abuse, resolve disputes, or comply with legal obligations.

Limited records may also be retained where reasonably necessary for security, fraud prevention, dispute resolution, legal, accounting, or regulatory obligations.

21. Third-Party Services

Giftodactyl relies on third-party services for parts of its operation, including infrastructure, authentication, app distribution, and merchant links.

Those services may have their own terms and privacy policies.

For example, signing in through Google or Apple or purchasing an item from a merchant involves services operated independently from WildPasta Co, LLC.

We are not responsible for third-party services outside our control.

22. Warranty Disclaimer

Giftodactyl is provided “as is” and “as available.”

To the fullest extent permitted by law, we do not guarantee that Giftodactyl will:

• always be available;

• operate without errors;

• work with every device or third-party service;

• contain accurate or current merchant information;

• successfully satisfy every Gift Exchange matching preference;

• cause another participant to purchase or deliver a gift; or

• meet every particular purpose or expectation.

You use Giftodactyl at your own risk.

Some jurisdictions do not permit certain warranty exclusions, so some of these limitations may not apply to you.

23. Limitation of Liability

To the fullest extent permitted by law, WildPasta Co, LLC will not be responsible for indirect, incidental, special, consequential, or punitive damages arising out of or related to Giftodactyl.

This includes losses arising from:

• interruptions or loss of access;

• loss of data;

• actions or omissions of other users;

• Gift Exchange participation or assignments;

• inaccurate merchant or product information;

• third-party websites or services;

• purchases made from third-party merchants; or

• another person’s failure to purchase, provide, ship, or deliver a gift.

To the fullest extent permitted by law, if WildPasta Co, LLC is found liable for a claim relating to Giftodactyl, our total aggregate liability will not exceed the greater of US $100 or the amount you paid directly to WildPasta Co, LLC for Giftodactyl during the twelve months preceding the event giving rise to the claim.

Some jurisdictions do not allow particular exclusions or limitations of liability, so these limitations may not apply to you.

24. Governing Law and Disputes

These Terms are governed by the laws of the State of Kansas, USA, without regard to conflict-of-law principles.

Subject to consumer rights, jurisdictional requirements, or dispute procedures that cannot legally be waived, disputes arising from these Terms or Giftodactyl will be resolved in the appropriate state or federal courts located in Kansas.

Some jurisdictions may provide additional consumer rights or require local dispute options, and these Terms do not limit rights that cannot legally be waived.

25. Changes to These Terms

We may update these Terms as Giftodactyl changes or as legal, operational, or platform requirements change.

If we make material changes, we may provide notice through the app or another reasonable method.

Where applicable law requires additional notice or affirmative consent to a change, we will provide it.

Updated Terms will identify their effective or last-updated date.

Your continued use of Giftodactyl after updated Terms take effect constitutes acceptance of the updated Terms where permitted by law.

26. General

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with any policies expressly incorporated into them, constitute the agreement between you and WildPasta Co, LLC regarding your use of Giftodactyl.
